1. All Dogs Pet Services will provide the services stated herein in a reliable, caring and trustworthy manner. In consideration of these services and as an express condition thereof, Owner expressly waives and relinquishes any and all claims against All Dogs Pet Services except those arising from gross negligence or willful misconduct on the part of All Dogs Pet Services. 2. Cash payments are to be made in person, or placed in a conspicuous location for pick up. Holidays – require a full payment of services at time of consultation. A finance charge of $10.00 per each of (5) business days outstanding will be added to unpaid balances after a one week grace period. A handling fee of $50.00 or ½ the total amount of the cheque (which ever is greater) will be added to all returned cheques. All Dogs Pet Services reserves the right to cancel service due to nonpayment at any time. 3. Payment for all subsequent services will be paid in full in the agreed upon manner, promptly at the time arranged with All Dogs Pet Services on the issued invoice. 4. Refund & Cancellation Policy – Dog Walking/Dog Daycare: If Owner plans to change their scheduled service, they must give All Dogs Pet Services a minimum of 72 hours notice to avoid being charged the agreed upon rate. Boarding (including Holidays): If Owner cancels, the entire booking fee will apply for all cancellations less than one week prior to scheduled sit. No refund on Holiday visits canceled one week or less before scheduled sits are to begin. 5. If Owner plans to increase their services needed, they can book all additional appointments via the Time to Pet service application. Owner agrees to pay all additional fees incurred promptly at the agreed upon date. 6. Any additional services not covered by the original service agreement, including but not limited to, “accident” clean up of urine or faeces, non-scheduled feedings, medicine administration, emergency care, and last-minute appointments made without 24-hour notice, are subject to an additional charge. 7. If a medical emergency arises for pet, All Dogs Pet Services will make every effort to contact the Owner but if time is of the essence Owner authorizes All Dogs Pet Services to seek medical services at Owner's preferred Veterinarian, or the closest Veterinarian Hospital. Owner agrees to reimburse All Dogs Pet Services for all services rendered by Veterinarian in accordance with Owners wishes. 8. In the unlikely event of illness or personal emergency to All Dogs Pet Services, Owner will authorize All Dogs Pet Services to arrange for another qualified person to fulfill responsibilities as set forth in this contract. Owner will be notified in such a case. 9. It is the Owners responsibility to make sure all of their pet(s) are current on their vaccinations. Should an employee of All Dogs Pet Services be bitten or otherwise injured by Owners pet(s), Owner agrees to pay all medical costs and lost wages incurred by All Dogs Pet Services due to such injury. 10. Owner is responsible for any injury caused to an employee of All Dogs Pet Services or the general public by Owner’s pet(s) or condition of Owner’s premises. 11. In the event of inclement weather or natural disaster, All Dogs Pet Services will use their best judgment in caring for Owners pet(s) and home but cannot be held responsible for any damage to home or injury to pet arising from such. 12. Owner is to notify All Dogs Pet Services if anyone else has keys or access to Owner’s property other than All Dogs Pet Services during the time the employee is caring for Owner’s home and pet(s). All Dogs Pet Services cannot be held liable for damage done to home and pet(s) by others with such access. In addition, All Dogs Pet Services shall not be held liable for damage done by pet to either the interior or exterior of home when All Dogs Pet Services is not there. 13. All Dogs Pet Services is not liable for pets that are left outside or may escape when All Dogs Pet Services is not in attendance. 14. Owner shall, at Owners sole expense, defend All Dogs Pet Services against any claim or demand, whether or not well founded arising from any act(s) of Owner’s pet(s) or relation to Owner’s property. Owner shall indemnify and hold All Dogs Pet Services free and harmless from all cost, expenses and liabilities in connection with such claims or demands. These costs, expenses and liabilities include amounts paid in settlement before or after suit is commenced, attorney’s fees and costs incurred by All Dogs Pet Services in defending against such claims or demands. 15. No term or provision of this contract shall be waived and no breach excused verbally. To be effective, each waiver or excuse shall be in writing and signed by the party who waived or excused. 16. Each waiver or excuse shall be independent of all other. Therefore, if a term or provision is waived or breach is excused, that waiver or excuse shall not waive any other term or provision or excuse any other breach. 17. In no event will All Dogs Pet Services be liable to Owner for any damages, including, but not limited to any lost profits, lost savings or their incidental or consequential damages arising out of Owners use of All Dogs Pet Services, nor will All Dogs Pet Services be liable for any claim by any third party, unless gross negligence or willful misconduct is proven on the part of the employee. 18. Owner authorizes this signed contract to be valid approval for future services of any purposes provided by this contract permitting All Dogs Pet Services to accept telephone reservations for service and to enter the premises without additional signed contracts or written authorization. 19. All training packages expire after a six month period. This is to ensure the timely execution of the training protocols applied, and is in the best interest of our canine clients and their learning propensity.
